Fremtidsbyene – Hvordan skal vi forholde oss til klimaendringene? Krav og virkemidler til kommunenes klimatilpasning i arealplanleggingen

Abstract

Norge har forpliktet seg til å halvere klimagassutslippene innen 2030, og en omstilling til lavutslippssamfunn innen 2050. Dette skjer imidlertid ikke over natten. Selv med ambisiøse klimamålsettinger, kommer konsekvensene av klimaendringene til å merkes. Det er derfor essensielt å tilpasse seg. Kommunene er førstelinjeinstans i klimatilpasningsarbeidet etter plan- og bygningsloven. Hvilke krav stilles til dem? Hvilke virkemidler har de til rådighet? Masteroppgaven ser på klimatilpasningens innvirkning i ferden fra overordnede planstrategier ned til detaljregulering, med særlig søkelys på kommunens utrednings-, kartleggings-, og gjennomføringsplikter for naturskadesikring, pålegg om klimatilpasningstiltak gjennom plan- og utbyggingsavtalebestemmelser, og en særskilt miljørevisjonsplikt for kommunenes eldre reguleringsplaner.

Norway has committed to halving greenhouse gas emissions by 2030, and to a transition to a low-emission society by 2050. However, this will not happen overnight. Even with ambitious climate targets, the consequences of climate change will be felt. It is therefore essential to adapt. The municipalities are the first-line body in the climate adaptation work according to the Planning and Building Act. What requirements are placed on them? What tools do they have at their disposal? The Master's thesis looks at the impact of climate adaptation in the journey from overall planning strategies down to detailed regulation, with a particular focus on the municipality's investigation, mapping and implementation obligations for natural damage protection, orders on climate adaptation measures through planning and development agreement provisions, and a special environmental audit obligation for the municipalities' older regulatory plans.
