"With intent to destroy": En analyse av kravet til dolus specialis i FNs folkemordkonvensjon artikkel 2

Abstract

Oppgaven undersøker kravet til dolus specialis, også kalt spesielt forsett, i FNs folkemordkonvensjon art. 2. Problemstillingen er hvordan kravet til dolus specialis skal tolkes i henhold til alminnelige folkerettslige tolkningsregler. Oppgaven bruker krigen i Ukraina som et praktisk eksempel på konsekvensene av gjeldende rett. Oppgaven konkluderer med at dolus specialis-kravet er preget av en vag og flertydig konvensjonstekst. Konvensjonstekstens forarbeider er preget av stor uenighet mellom partene, som har ført til at formålsbetraktninger og rettspraksis er sentrale rettskilder i tolkningsprosessen.

The topic of the thesis is the special intent requirement, also referred to as the dolus specialis, of the UN Genocide Convention Art. 2. The main question the thesis poses is how the dolus specialis requirement is to be interpreted on the basis of conventional treaty interpretation rules. The war in Ukraine is used as an example of what the consequences of the current state of law could be in regards to the dolus specialis requirement. The thesis concludes that the treaty text is ambiguous and vague in relation to the dolus specialis requirement. The travaux preparatoires illustrate great differences between the parties to the treaty. This has led to the object and purpose of the treaty, and case law from international courts, to become key sources of law in the interpretation of the dolus specialis requirement.
