Tilbakekallelse av rettigheter til åndsverk ved manglende bruk: En sammenlikning av forfattervernet etter DSM-direktivets artikkel 22, forslag til åvl. § 74 og forlagsbransjens normalkontrakt

Abstract

Avhandlingen sammenligner forfatteres rett til å tilbakekalle råderett over åndsverk ved manglende bruk etter artikkel 22 i EUs Digitalmarkedsdirektiv av 2019, norsk lovforslag til ny åvl. § 74 og standardavtalene "normalkontraktene" som brukes i store deler av forlagsbransjen. Oppgaven tar særlig for seg hvordan bestemmelsene må forstås i lys av nyere digital utvikling i forlagsbransjen.

The thesis compares the author's right to revoke a licence or transfered right to å copyrighted work according to article 22 of the EU directive on copyright and related rights in the Digital Single Market of 2019, the Norwegian proposal for a new § 74 of the Norwegian copyright law and the standard contracts used in the Norwegian publishing business. The thesis adresses how the acts should be interpreted and implemented in light of digital developments in the area of book publishing.
