Abstract
En konsekvensutredning av straffeprosessutvalgets forslag til innføring av stadienøytralitet i lovfesting av bevisforbud i norsk straffeprosess. Oppgaven tar for seg prinsipp og hensyn i relasjon til bevisforbud og hvordan bevisforbud praktiseres under dagens rettstilstand. Videre går oppgaven inn i en analyse av straffeprosessutvalgets forslag. Under analysen vektlegges særlig om forslaget er konformt med de prinsipp og hensyn som gjør seg gjeldende i vurdering av bevisforbud, så vel som hvilke konsekvenser en gjennomføring av forslaget får for dagens rettspraksis. An Impact Assessment of the Committee on Criminal Procedures’ (straffeprosessutvalgets) bill proposal and the introduction of stage neutrality in exclusionary rules for evidence in Norwegian criminal law. The thesis assesses principles and considerations in relation to exclusion of evidence and how exclusionary rules for evidence is practiced in today's legal situation. Furthermore, the thesis undertakes an analysis of the Committee on Criminal Procedures’ bill proposal. During the analysis, special emphasis is placed on whether the bill proposal is in accordance with the principles and considerations which are relevant in regards to exclusionary rules for evidence, as well as the consequences of the implementation of the bill proposal.
