Med jussen som utgangspunkt. Et blikk på rett og litteratur-disiplinens behandling av "Billy Budd, Sailor"

Abstract

Denne oppgaven er en resepsjonsstudie som undersøker rett og litteratur-disiplinens behandling av Herman Melvilles kortroman Billy Budd, Sailor. Dette gjøres gjennom undersøkelse, vurdering og sammenligning av Richard Weisberg, Richard Posner og Brook Thomas sine lesninger og fortolkninger av verket. Jeg viser - gjennom å lansere begrepet "juridisk-historisk" metode - hvordan de tre leserne foretar en aktiv juridisk fortolkning av Veres juridiske fremferd og argumentasjon, opp mot kortromanens rettshistoriske kontekst. Jeg vil konkludere med at selv om lesningene varierer i overbevisningskraft og undergraver hverandres konklusjoner - særlig knyttet til den juridiske fortolkningen - utgjør de likevel et relevant bidrag til Billy Budd-resepsjonen.

This thesis is a critical study examining how Herman Melville's novella Billy Budd, Sailor (1924) has been interpreted within the interdisciplinary field of Law and Literature. By a comparative revision and evaluation of the readings done by Richard Weisberg, Richard Posner and Brook Thomas, I will show how they - through what I call judicial-historical method - interpret the law and legality of Captain Vere's behaviour in the story within the context of legal history. As a conclusion, I will claim that even though the interpretations vary in plausibility and often lack textual evidence for their opposite conclusions - especially the judicial parts of the interpretations - they do in fact represent a relevant contribution to the critical reception of Billy Budd, Sailor.
